Your Three Legal Pathways for Viewing a Property

As of January 1, 2026, Texas real estate regulations give consumers specific choices in how they tour residential properties. A licensed agent cannot simply open a door without establishing the legal nature of the interaction first.

You have three distinct options when you want to view a home in person.

Here is exactly how they work, along with the pros and cons of each path:

The Listing Agent Path

Legal Status: Unrepresented Customer
The Rule: You contact the seller's agent directly to view their specific listing.

  • Pros: You do not have to sign an agency contract with an independent broker. If you only want a quick look at one specific house and do not want an ongoing relationship, this is a direct route to getting the door unlocked.

  • Cons: The listing agent has an absolute legal and fiduciary duty to the seller. By law, their job is to get the seller the highest price and best terms. Anything you say about your budget, motivation, or timeline can and will be used to the seller's advantage during negotiations. They are legally barred from giving you any advice or market data.

  • Cons: At an Open House, if any Agents hosting are NOT the Listing Agent, those Agents will need you sign a Buyer's Rep Agreement, or ask you to leave. Only the Seller's Listing Agent can allow access to the home without any paperwork.

The Independent Agent "Door-Opener" Path

Legal Status: Unrepresented Customer (TXR 1508 Form)

The Rule: You call any agent to show you a home, but choose not to hire them. You sign the mandatory Unrepresented Customer Showing Form before entry.

  • Pros: You get access to view the home with a licensed professional without making a long-term contractual commitment or hiring an agent. It provides immediate property entry while keeping your independent options open.

  • Cons: Under the TXR 1508 framework, the agent is acting strictly as a structural door-opener. By law, they cannot provide you with any professional advice, comparable market sales data (comps), valuation opinions, or strategic guidance. They must remain completely neutral, leaving you entirely on your own to interpret contracts and navigate pitfalls.

The Dedicated Advocate Path

Legal Status: Represented Client

The Rule: You hire an independent agent to protect your interests, executing a Buyer Representation Agreement before viewing properties.

  • Pros: This option completely unlocks the agent's professional toolbox. You receive full fiduciary protection, custom neighborhood closing data (comps), strategic offer advice, contract contingency safeguards, and active negotiation management. We can use a short-term, property-specific agreement so you aren't tied into a long contract before knowing if we are the right fit.

  • Cons: Requires a formal, written agreement to be reviewed and signed before any home tours can take place, establishing clear and transparent parameters for professional compensation up front.
